Terms and Conditions:
These Terms and Conditions together with the estimate of works (“Proposal”) provided by Marika Nad Design which describe the services set out the entire agreement between Marika Nad Design and you (the “Client”) and will apply once an appointment has been made to provide Marika Nad Design services (the “Services”).
Before procuring the Services, you should read these terms and conditions carefully. If you do not agree with them, do not use the Services. By paying your instalment you are agreeing to these terms and conditions.
1. Marika Nad Design has been retained to provide traditional interior design services and virtual design services. Marika Nad Design is not a general contractor and will not act in such capacity. Any issues concerning construction elements must be discussed between owner/client and the contractor.
2. For traditional Design Service - initial visits will be scheduled within 1 week or per your own schedule and availability. Service available only in Greater London and 1- hour travel from London.
3. For online interior design service - we will ask you to provide us with latest room photographs, we will give you full instructions of how to measure room and fill in our questionnaire. After obtaining required information we will provide a tailored digital design and select a specially chosen list of items which the client can then choose to purchase.
4. If a client has a room which measures over 4 m x 4 m or has a large open place space, additional charges may apply.
5. Where the Client chose traditional Design Service - Marika Nad Design will endeavour to advise the client of the predicted timescale of works as soon as is possible after the quotes have been produced. All such dates shall be approximates
only and Marika Nad Design cannot be held responsible for any delay in projects or project completion dates - for any reason.
6. Where Marika Nad Design is responsible for organising Third Party companies, firms or individuals (“Third Party Suppliers”) to undertake certain work for the Client, such as decorating, building work, carpet fitting, curtain and blind manufacture and fitting and such other work during full packages, the contract of work is between the client and the contractor and not with Marika Nad Design so we cannot be held responsible for any damages or inconvenience caused by 'third party suppliers' but will do our best to mediate on your behalf should it be necessary.
7. The Client shall ensure that the property is accessible to employees of Marika Nad Design and any third-party suppliers providing services throughout the duration of the works. You will be required to pay any fees or rates suffered from access being denied.
8. The client will ensure that utilities such as electricity and water are available for use at the property throughout works and at no cost to Marika Nad Design.
9. The client shall make Marika Nad Design aware of any delays they may have with providing any relevant information partaking to the project and if delays are caused which stop Marika Nad Design for fulling the contract, Marika Nad Design is obliged to terminate the contract after 48 days or place a break on the contract until a later date
if appropriate.
10. Parking must be arranged or made available for Marika Nad Design or outside contractors when working on project days. Any fees for this are payable by you if required - that includes the use of a skip or other hired on-site equipment and
essentials.
11. Marika Nad Design accept no responsibility for any false, unclear or inaccurate measurements provided by the client.
12. Marika Nad Design do not accept any responsibility or liability for any incorrect furniture ordered by the client, or furniture that may be the wrong size, wrong colour or arrive damaged.
13. In cases where furniture or accessories have been rented, it remains the Client’s responsibility to insure the furniture and accessories against all risks, damage or loss.
14. Marika Nad Design work on the assumption that all clients check the dimensions of the furniture pieces recommended to them before purchasing. This includes ensuring that the Products ordered will pass freely into your room of choice, they fit in that room, can be transported through the door of your flat or room, stairs and doorways, and there are no other issues that could make delivery more complicated or impossible. Marika Nad Design will not accept any liability or responsibility for
furniture ordered by the client that isn’t to their satisfaction or needed to be
returned.
15. Marika Nad Design will endeavour to scale up floor plans provided by the client or the clients contractor to the best of their ability and as accurately as possible. We do however require all clients to check these floor plans are accurate and correct before beginning any form of design work such as hiring tradesmen, requesting quotes and purchasing furniture etc.
16. If a client does not respond to their designer or initiate contact for an extended period of time and reinstates contact more than 3 months down the line, the designer is not required to carry out further design work free of charge. Additionally, if the
designer does not hear back from the client within 3 months the project will be regarded as completed and no further work will be carried out.
17. Due to the nature of the Interior Design business we cannot guarantee that Clients will always like our recommendations. Interior Design can be subjective. Unfortunately, we cannot provide any refunds in this case. However
please feel free to contact Marika Nad Design and we will be happy to discuss the design concept further with you and perhaps make further recommendations via phone/email or visit in special cases.
18. Payment must be received in full before work can commence. All payments to Marika Nad Design are due within 14 days of presentation of invoice. Works may be halted until payment is made.
19. Client may cancel our Services within fourteen (14) days of the Effective Date by notifying Marika Nad Design by email, in which case client will be refunded the Client Payment less a sum that reasonably reflects the value of our Services already
provided up to date of cancellation. If the cancellation request is received more than fourteen (14) days after the Effective Date, client will not be entitled to a refund.
20. Any quote given is valid for 30 days only. Quotes after the 30-day period are over will be considered as invalid and will require a new quote to be made.
21. You certify that all details provided to Marika Nad Design for the purpose of ordering design services or goods are true, accurate, current and complete in all respects. You also certify that the payment method used is your own and that there are sufficient funds in your account to cover payment of goods and services.
22. You agree to provide Marika Nad Design with a valid email and phone number for contact purposes during the design process.
23. Marika Nad Design accept no responsibility for changes in price, stock issues or accuracy of information provided by third-party vendors or suppliers.
24. Marika Nad Design reserves the right to reject projects based on scheduling conflicts.
25. Marika Nad Design reserves the right to cancel services without notice.
26. Client agrees to permit Marika Nad Design to photograph the Project upon completion. Marika Nad Design will be entitled to use such photographs for portfolio and business purposes, but shall not disclose the Project location or Client's name without Client's prior written consent
27. Any clients based outside of the UK, for example within the EU and USA, when engaging in a work relationship with Marika Nad Design, are subject to UK laws. Marika Nad Interiors will not be complying with US, Canadian or EU laws, strictly UK laws.
